Zuton convicted of assault

Zutons frontman Dave McCabe has been convicted of assault for breaking a man’s nose when he headbutted him outside Liverpool’s Korova venue earlier this year.
As previously reported, the incident happened at around 3.30am on 21 Feb after a group of five men insulted the Zuton man’s girlfriend. One of the men in the group suggested that the fur collar of McCabe’s girlfriend’s coat made it look like she had a beard. She overheard this comment and reacted angrily. McCabe then approached the men and headbutted one of them, Peter Appleby, breaking his nose. According to Appleby, he had not made the comment, but was singled out because McCabe saw him laughing.
However, giving evidence on Tuesday, McCabe said that he had acted in self-defence, telling the court: “They were surrounding me and I said they couldn’t pick on us like that. [Appleby] raised his hand and I could tell from his body language that he was going to punch me, so I headbutted him and backed off”.
But the jury ultimately believed Appleby’s version of events, finding McCabe guilty of assault occasioning actual bodily harm. He will be sentenced on 29 Oct.
