Former (for the foreseeable) AC/DC drummer Phil Rudd spent yesterday in custody after being caught allegedly drinking this weekend, contravening the rules of his home detention that stemmed from charges he threatening to kill a man.

As previously reported, Rudd pleaded guilty to making threats against a man who had worked on the promotion of his solo album, and was sentenced in the New Zealand courts earlier this month to eight months home detention and strict rules to stick to a drug and alcohol rehab programme. The judge hearing the case told the drummer that he faced jail if he broke the terms of his house arrest.

He was arrested on Saturday night for the alleged violation, and spent Sunday in jail before a court hearing this morning. Rudd didn’t enter a plea regarding the allegation he broke the terms of his detention, but his lawyer asked that the new case be pushed back to a 3 Aug hearing, and that his client be granted bail in the meantime.

The judge complied, though at the request of a community probation officer gave local police extra powers to subject Rudd to random drug and alcohol testing. He also told the drummer that any future violations of his home detention rules would result in a change to his sentence, which could include full-on jail time.

As previously reported, Rudd’s lawyer had originally asked that his client’s sentence not limit his movements so that he could rejoin his bandmates on their current tour, though it’s not especially clear that the rest of AC/DC want him back in the band anytime soon.
