Chubby Checker settles with HP over the Chubby Checker

Chubby Checker has settled with Hewlett-Packard in the previously reported dispute over the IT firm selling, for a short-time, a penis size estimating app in its proprietary app store.
The Chubby Checker – as in the app, not ‘The Twist’ star – estimated penis size based on shoe size, a useless methodology which might be why the app was reportedly only downloaded 84 times before a cease and desist from Chubby Checker – ‘The Twist’ star, not the dick app – resulted in it being removed from sale.
Nevertheless, Checker sued for mega-bucks, claiming the app had resulted in “irreparable damage and harm” to his reputation and brand. It seemed like an ambitious lawsuit from the start, though it was interesting in that it tested whether an app store operator could be liable for infringements by the app makers whose products it sells.
But no court hearing will now take place as the two parties have reached an undisclosed settlement, crucially without HP accepting any liability, thus ensuring no informal precedent is set.
